A UK Responsible Person is the individual or company, established in the UK, that takes legal responsibility for a cosmetic product’s compliance and safety. Every cosmetic product sold in Great Britain must have one — it’s a legal requirement. The Responsible Person maintains the Product Information File, submits the SCPN notification, and acts as the point of contact for the regulator. Since Brexit, an EU Responsible Person cannot cover the UK market.
What does a Responsible Person do?
The Responsible Person (RP) carries the legal accountability for making sure a cosmetic product meets UK requirements. Their duties include:
• Ensuring a valid CPSR and Product Information File exist and are kept up to date.
• Submitting the product notification through the UK’s SCPN system before sale.
• Keeping the PIF available for inspection by the Office for Product Safety and Standards.
• Acting as the point of contact for the regulator and cooperating on any safety matters.
• Taking action if a product is found to be non-compliant or unsafe.
Do you need one?
Yes — if you sell cosmetics in Great Britain, every product must have a UK Responsible Person. There are no exceptions for small brands, natural products or overseas sellers. Without an RP in place, a product cannot legally be placed on the UK market.
Who can be a UK Responsible Person?
The RP must be established in the UK. It can be the brand itself (if UK-based), an importer, a distributor, or a specialist third-party RP service. Many overseas brands use their UK distributor as the Responsible Person, since it consolidates the legal, compliance and logistics roles in one partner.
The post-Brexit point that catches brands out
Before Brexit, an EU Responsible Person covered the UK. That is no longer the case. Selling in Great Britain now requires a UK-established Responsible Person and SCPN notification, entirely separate from the EU’s system. A brand selling in both markets needs a Responsible Person in each. This is the single most common compliance surprise for brands expanding into the UK.
